Mr. Gagliardi is a shareholder with over 20 years experience practicing business and intellectual property litigation. He has litigated the gamut of intellectual property matters, including trade secret misappropriation, copyright and patent infringement suits, as well as a wide range of complex business disputes, including class actions, breach of complex commercial contracts, breach of fiduciary duty, fraud, securities fraud, unfair business practices, contractor licensing and franchise law in federal and state courts throughout California and beyond. Mr. Gagliardi also has trial, arbitration and appellate experience. Mr. Gagliardi was previously a partner at Bergeson, LLP and an associate for Steefel, Levitt & Weiss, as well as a law clerk to the Hon. John T. Elfvin, United States District Judge for the Western District of New York, and to the Hon. Edward A. Infante, United States Magistrate Judge for the Northern District of California. Mr. Gagliardi has served as a judge pro tem for the Santa Clara County Superior Court and as a special master for discovery disputes in the United States District Court for the Northern District of California. • Won jury verdict after trial of dispute involving security infrastructure at Oakland Airport and won affirmance on appeal as well as award of attorneys’ fees.
• Won dismissal of several hundred million lawsuit for internet search engine firm and won affirmance on appeal.
• Won dismissal of copyright infringement suit for corporate officer in federal district court in Washington.
• Won dismissal of a franchise class action in Los Angeles County Superior Court.
• Won favorable jury verdict after trial on real estate joint venture dispute in Sacramento County Superior Court.
• Successfully settled multiple patent infringement suits.
• Represented former CEO and president of publicly-traded company in class action and derivative litigation involving allegations of stock option grant backdating.
