One of the firm's most rapidly expanding specialties is patent infringement and trade secret litigation. Matters recently concluded have involved printed circuit board technology, disk drive components, removable hard-disk products and even golf clubs.
The firm was lead counsel for the accused, R.E. Service, in the recently decided case of Johnston & Johnson Associates v. R.E. Service, in which the Court of Appeals for the Federal Circuit, sitting en banc, held that matters disclosed in the specification of the patent, but not expressly claimed therein, are dedicated to the public and may not be used to charge infringement by equivalents. This landmark decision will dramatically reduce the reach of the doctrine of equivalents and is must reading for patent prosecutors and litigators alike, especially since there will be no further review of the matter by the U.S. Supreme Court.
The firm has had experience handling both sides of infringement litigation, and is one of the few Silicon Valley firms willing to undertake intellectual property litigation on a contingent fee basis. The firm has effected several multi-million dollar recoveries for its I.P. clients in recent years.
